| Summary, etc. | L’article retrace les dix années de l’histoire de la Commission nationale de déontologie de la sécurité jusqu’à son absorption fusion dans le dispositif du Défenseur des droits. Il montre le particularisme du dispositif français dans l’édifice des diverses autorités administratives, les entraves légales du développement de ses activités jusqu’en 2006 par le biais d’une saisine plutôt rare, les raisons de sa montée en puissance à partir de 2007. Le regard externe et interne des auteurs permet de mieux évaluer les différents impacts des recommandations de la Commission sur les conditions espérées d’une mise en œuvre avec plus de discernement de la contrainte chez les différents acteurs de la sécurité concernés. Il conclut à un bilan de son activité décennale en demi-teinte et pose d’utiles jalons de diagnostic sur les conditions d’efficacité du nouveau dispositif qui le relaie désormais. |

| Summary, etc. | — The National Commission on Ethics in Security Practices : wielding influence — In this article, the authors recount the ten year old history of the National Commission on Ethics in Security Practices until its final absorption or merger with the new entity, the new French Protection of Rights Body, le Défenseur des droits. The article explains the specific features of this new Body located within the maze of various administrative authorities. It shows how its growth was legally hampered by the very low number of cases submitted to it until 2006 and the reasons for its rapid development from 2007 onwards. The authors present the situation as seen from inside and outside, thus making it easier to understand the varying results of the recommendations made by the Commission for achieving the much hoped exercise of greater discernment in the use of force by the various relevant categories of security staff. The article concludes with the mediocre performance of the ten year old entity, analyses what went wrong and gives useful suggestions on what is needed to make the succeeding body more effective. |
