| Summary, etc. | Résumé En Espagne, la loi 2/2011 sur l’économie durable s’attache entre autres à rationnaliser, dans une logique transversale commune, les statuts des autorités de régulation indépendantes. L’intérêt de cette réforme législative est, au‑delà de la mise en conformité du droit espagnol avec le droit de l’Union européenne, d’uniformiser les statuts et le fonctionnement des « Autorités de régulation indépendantes » en fonction d’un schéma beaucoup plus respectueux de leur nécessaire indépendance. Même si certains éléments restent critiquables, les principaux reproches que l’on pouvait faire sur le manque d’indépendance fonctionnelle dans l’ancien cadre législatif ne sont plus de mise. La législation espagnole offre donc un cadre dont peuvent utilement s’inspirer les pouvoirs publics des autres États membres de l’Union européenne. |

| Summary, etc. | — The Independence of Economic and Financial Regulatory Authorities in Spain: Interest of Public Law Clarification — In Spain, the 2/2011 sustainable economy law aims, inter alia, to streamline the statutes of independent regulatory authorities across the board. The purpose of this legislative reform is not only to bring Spanish law into line with EU law but moreover to harmonise the statutes and the operation of “Independent Regulatory Authorities” through a system which much better protects their necessary independence. Although some aspects may be considered objectionable, the main criticisms levied against the lack of operational independence within the former legislative framework are no longer valid. Spanish legislation now therefore provides a framework which other EU member states’ public authorities can view as a model. |
