| Summary, etc. | Résumé Les transformations de la responsabilité administrative sont appréciées par rapport à celles que les anciens auteurs qui ont traité ce sujet (Léon Husson, François Fairé), ont pu déceler à l’époque où ils ont écrit. L’évolution contemporaine semble se caractériser par un approfondissement de la notion de responsabilité administrative et du concept de réparation qui l’accompagne, par comparaison avec les notions de solidarité, d’indemnisation, de compensation. De ce fait, l’autonomie de la responsabilité administrative, entendue du point de vue de son exorbitance, demeure une question débattue. Toutefois, et malgré la reconnaissance par le juge administratif de principes généraux régissant la responsabilité de la puissance publique, il n’y a toujours pas, paradoxalement, de principe général de la responsabilité de la puissance publique, comme il y a un principe général de la responsabilité des personnes privées. Le regard porté sur les transformations étudiées part d’un constat, à savoir l’éclatement des catégories juridiques traditionnelles de la responsabilité administrative, pour aboutir à une tentative d’explication, tenant à la recherche de l’effectivité de la responsabilité administrative. |

| Summary, etc. | Focus on administrative responsibility transformations Administrative responsibility transformations are assessed in relation to those identified by previous authors on the subject (Léon Husson, François Fairé), during the period at which they were writing. Contemporary developments seem to be characterised by a deepening of the concept of administrative responsibility and the accompanying notion of redress, in comparison with the notions of solidarity, indemnification and compensation. Thus, the autonomy of administrative responsibility, understood in terms of its unconscionability, remains a debated issue. Nevertheless, and despite recognition by the administrative judge of the general principles governing the responsibility of public authorities, there is still, paradoxically, no general principle of public authority accountability, as there is when it comes to individual liability. This focus on the changes studied is based on an observation, namely the breakdown of traditional legal categories of administrative responsibility, culminating in an attempt at an explanation, looking into the effectiveness of administrative responsibility. |
