| Summary, etc. | RésuméL’institutionnalisation de l’étude d’impact des réglementations dans l’Union européenne a permis une amélioration de la prise de décision. Elle révèle cependant des incohérences dues au trop grand centralisme dans le dessin et la conduite de l’outil. C’est le résultat du volontarisme de la Commission européenne et de la procrastination du Parlement et du Conseil. On observe un réveil bienvenu de ces institutions vis‑à‑vis de l’outil administratif. Il doit cependant être raisonné pour ne pas conduire à d’autres incohérences. Dès lors, un nouvel accord interinstitutionnel, portant notamment sur la coopération des institutions dans leurs comportements pré‑décisionnels, devient urgent. |

| Summary, etc. | — The Interinstitutional Dimension of Regulatory Impact Assessment in the European Union at the age of Smart Regulation — The institutionalization of the regulatory impact assessment in the European Union enabled to improve decision‑making. Inconsistencies are revealed due to an excessive centralism in the design and conduct of the tool. This results from the European commission voluntarism and from the Parliament and Council procrastination. An opportune awakening can be noticed from those institutions towards administrative tool. However, this tool needs to be properly justified in order to avoid others inconsistencies. Therefore, a new interinstitutional agreement, in particular on cooperation of the institutions in their pre‑decision‑making behaviors, become pressing. |
