| Summary, etc. | Le droit à l’oubli est précurseur en matière de libertés publiques dans la mesure où il lie l’État de droit et l’existence humaine dans une société où s’impose comme incontournable la technique numérique, soulevant des enjeux de sécurité et de confiance pour les citoyens. Le droit à l’oubli permet aux individus d’œuvrer pour leur liberté, et invite l’État, sinon l’oblige (conformément à la logique de l’État de droit), à se défaire de sa compétence de surveillance. In fine, il s’agit pour les deux parties (État et citoyens) d’honorer la promesse du contrat social pour construire l’avenir. |

| Summary, etc. | The right to data protection is a necessary basis for all issues relating to public liberties, in so for as it links human existence and human rights in a society in which digital technology is unavoidable. It raises challenges of citizens’security and faith in democratic systems. The right to data protection allows citizens to fight for their freedom, and encourages or even obliges the State (in accordance with the logic of the rule of law) to relinquish certain powers of surveillance. Ultimately, the two parties (the State and Citizens) must honour their commitments to the social contract as a means of building a future. |
