| Summary, etc. | La loi Hamon de 2014 a créé un cadre juridique instituant une forme spécifique d’entreprise, relevant de l’économie sociale et solidaire, dont l’objet fondateur poursuit une utilité sociale. L’adoption de cette loi converge avec un changement de définition du rôle de la société civile qui est mobilisée, à l’initiative des collectivités publiques, au service de politiques publiques dans de nombreux domaines (cohésion sociale, insertion, éducation, environnement, culture, etc.). Il convient donc de différencier les pratiques appartenant à l’économie sociale, au sens du mouvement historique ayant émergé au début du XIXe siècle de celles relevant désormais de l’économie sociale et solidaire entendue comme acteur de référence en matière d’innovation sociale et transcendant les frontières du public et du privé. |

| Summary, etc. | From historical « social economy » to new « social and solidarity economy » : a new configuration of relationships between non-profit sector and public bodiesIn France, a 2014 legislative act gave a dedicated legal framework to a specific form of companies whose corporate object is intended to pursue social values. The context of this act is marked by a new role of civil society which is tasked by public bodies to deliver numerous social policies (social cohesion, insertion, education, environment...). It is then worth differencing non-profit practices arising from “social economy” approach, in the sense of the historical movement that took root at the beginning of the XIX˚ century, from the “social and solidarity economy” in the sense of a group of bodies which may be considered as key players in the field of social innovation cutting across the boundaries between private and public sectors. |
