| Summary, etc. | RésuméL’objectif de cet article est d’analyser la place de la transparence dans la déontologie administrative en France depuis les années 1970. L’étude historique de la transparence à la fois comme valeur du service public et instrument déontologique de contrôle des comportements permet de mettre en perspective les innovations de la loi sur la déontologie du 20 avril 2016. Cette dernière consacre l’utilisation de mécanismes préventifs de transparence pour s’assurer de la « bonne » conduite des fonctionnaires mais relègue la transparence dans la hiérarchie des valeurs fondamentales du service public. Elle réaffirme par ailleurs le rôle de la Commission de déontologie de la fonction publique et du Conseil d’État en tant que gardiens des bonnes pratiques administratives. |

| Summary, etc. | Between public service value and ethical tool:vWhich place for transparency in the “right” behavior of public sector officials in France (1970-2016)?–This article analyses the role of transparency in public administration ethics in France since the 1970s. The historical study of transparency, both as a public service value and an ethical tool used to control behaviors, puts into perspective the innovations of the ethics law of 20 April 2016. This law supports the use of preventive mechanisms of transparency in order to ensure the “right” behavior of public sector officials but at the same time lowers the place of transparency in the hierarchy of public service’s core values. The law also consolidates the role of both the Public Service Ethics Commission and the Council of State as the guardians of good administrative practices. |
