| Summary, etc. | RésuméLa réduction de l’asymétrie entre usagers et responsables de traitements informatisés nécessite la création de droits adaptés. Tel est le cas du droit à la portabilité pour les services numériques. Ce droit est à la fois un droit économique, prolongeant le droit à l’interopérabilité, et un droit des personnes, participant à garantir leur autodétermination informationnelle. Ses deux sources en France sont, d’une part, le règlement général sur la protection des données, adopté au niveau européen, et, d’autre part, la loi Pour une République numérique. La mise en œuvre pratique de ce droit, tant par les acteurs privés que publics, est de nature à réduire les effets de rente et favoriser la création de services nouveaux. |

| Summary, etc. | Portability of digital data and servicesReducing the asymmetry between users and data controllers of computerised data processing requires the creation of appropriate rights. This is the case of the right to portability for digital services. This right is both an economic right, extending the right to interoperability, and an individual right, aiming at enforcing the informational self-determination of people. The two sources of this right in France are the General Data Protection Regulation (adopted at European level), and the 2016 Act on a digital Republic. The practical implementation of this right, by both private and public actors, is likely to reduce rent effects and promote the creation of new services. |
