Pour autant, cela ne signifie pas qu’il n’intègre pas dans son raisonnement des éléments d’une autre nature, et notamment des outils empiriques. Le recours à de telles données est certes parfois envisagé par le Conseil constitutionnel, qui peut alors les mobiliser tant pour contrôler la justification de la loi que pour interpréter celle-ci. Ce maniement des données empiriques semble toutefois se rattacher à une démarche non assumée de la part du Conseil constitutionnel et continue de manquer de visibilité et de lisibilité. |

Summary, etc. | The Constitutional Council traditionally exercises what is called an abstract review of legal acts, supposed to be from legal norm to legal norm, without considering extra-legal considerations, at least in an explicit manner. However, this does not mean that it does not include another kind of elements, especially empirical tools, in its reasoning. The use of such data is sometimes taken into account by the Constitutional Council, which mobilizes them either to check the justification of the law, either to interpret it. However, this use seems to be linked to an approach that has not been formally endorsed and that therefore lacks visibility and legibility. |
