| Summary, etc. | Le contrôle de proportionnalité exercé par la Cour de justice de l’Union européenne semble naturellement pouvoir constituer un terreau fertile pour la prise en considération des données empiriques. La Cour tend à s’assurer que le législateur de l’Union produise une analyse d’impact au soutien des actes qu’il adopte, et démontre qu’il a pris en considération l’ensemble des éléments pertinents. Néanmoins, ce contrôle demeure limité. Par ailleurs, lorsqu’elle examine les actes nationaux, la Cour se montre réticente envers les données empiriques invoquées par les États membres, ce qui s’explique par l’approche in concreto inhérente au raisonnement en termes de proportionnalité. La Cour peut toutefois mobiliser de telles données au service de l’effectivité du droit de l’Union. |

| Summary, etc. | The proportionality review carried out by the European Court of Justice seems to be a breeding ground to take into account the empirical evidence. The Court tends to require from the European legislator the production of an analysis of impacts, and due consideration of all relevant elements before the adoption of an act. Nevertheless, this control is still limited. Moreover, when it examines national acts, the Court remains reticent about the empirical evidence invoked by member states. This may be explained by the in concreto approach inherent in the proportionality test. However, the Court sometimes mobilises this data in support of an effective application of EU law. |
