| Summary, etc. | L’UE se trouve aujourd’hui inconfortablement située à la frontière entre la gouvernance administrative et le constitutionnalisme supranational. À ce jour, cependant, la réticence des États membres à doter l’UE d’un pouvoir autonome de mobilisation obligatoire des ressources fiscales et humaines a jeté un doute sérieux sur le caractère constitutionnel autonome de l’UE. Le caractère fracturé entre les États membres de la « constitution métabolique » de l’UE, c’est-à-dire la manière polycentrique dont les ressources sont mobilisées aux fins de l’intégration européenne, laisse l’UE incapable de transcender ses propres limites socio-juridiques et socio-institutionnelles en tant que forme de gouvernance administrative. La limite la plus fondamentale découle de la déconnexion entre le pouvoir et la légitimité, c’est-à-dire l’attribution répétée d’un pouvoir réglementaire aux institutions européennes, sans que l’UE ne bénéficie de la légitimité démocratique et constitutionnelle nécessaire pour soutenir l’exercice de ces pouvoirs par une mobilisation autonome des ressources. Cette contribution explore comment la rupture de ce nécessaire « lien pouvoir-légitimité » s’est manifestée dans la gouvernance de l’UE au cours de la dernière décennie, surtout dans la crise de la zone euro. Nous examinons ensuite si la réponse à la pandémie de coronavirus (le plus important, l’instrument de relance Next Generation EU) peut constituer un changement de paradigme – une « phase critique » ( critical juncture) – dans la constitution métabolique « fracturée » de l’UE. En conclusion, nous considérons ce qui pourrait être nécessaire pour dépasser, dans la gouvernance européenne, la délimitation existante entre le pouvoir administratif et le pouvoir constitutionnel. |

| Summary, etc. | The EU today sits uncomfortably at the boundary between administrative governance and supranational constitutionalism. To date, however, the unwillingness of Member States to equip the EU with an autonomous power to mobilise fiscal and human resources in a compulsory fashion has cast serious doubt on the EU’s autonomous constitutional character. The EU’s fractured “metabolic constitution” among the Member States— that is, the polycentric manner in which resources are mobilised toward the ends of European integration—leaves the EU unable to transcend its own socio-legal and socio-institutional limitations as a form of administrative governance. The most fundamental limit flows from the disconnect between power and legitimacy, by which we mean the repeated conferral of regulatory power on European institutions, albeit without the EU enjoying the necessary democratic and constitutional legitimacy to support the exercise of those powers through autonomous mobilisation of resources. This contribution explores how the break in this necessary “power-legitimacy nexus” has manifested itself in EU governance over the last decade, most importantly in the Eurozone crisis. We then examine whether the response to the coronavirus pandemic (most importantly, the Next Generation EU recovery instrument) may constitute a paradigm shift — a “critical juncture” — in the EU’s fractured metabolic constitution. In conclusion, we consider what might need to happen in order to transcend the boundary between administrative and constitutional power in European governance. |
