| Summary, etc. | RésuméLorsqu’un psychanalyste envisage d’écrire et de publier un texte à partir d’un matériel tiré d’une cure analytique vécue avec l’un de ses patients, il doit faire preuve d’une grande prudence, car il va extraire de l’intimité de l’analysant des éléments susceptibles de permettre à ce dernier de se reconnaître dans la description du cas publié ou à des tiers d’identifier quelqu’un de son entourage familial, amical ou professionnel, ce qui pourra être ressenti comme une violation de sa confidence. Le patient au regard de la loi aura été victime d’une atteinte à sa vie privée doublée d’une violation du secret professionnel auquel est tenu de manière absolue le psychanalyste qui pourra alors être condamné. Des précautions sont donc à prendre par l’auteur d’une telle publication pour éviter toute identification de l’analysant dont l’histoire est racontée. |

| Summary, etc. | When a psychoanalyst considers writing a text for publication based on material from an analytic treatment experienced with one of his patients, he must show extreme caution, for he will draw some elements from his analysand’s private life that may enable the latter to recognise himself in the published case description or enable third parties to identify a member of their family or a friend or colleague, which may be felt as a betrayal of his trust. In the eyes of the law, the patient will have suffered an attack on his privacy combined with a breach of the professional secrecy that is absolutely binding for the psychoanalyst, who may then be condemned. The author of this kind of publication must therefore take precautions to prevent any identification of the analysand whose history is related. |

| Summary, etc. | ResumenCuando un psicoanalista toma la decisión de escribir y publicar un texto a partir del material sacado de una cura analítica vivida con un paciente, tiene que ser muy prudente puesto que va a extraer de la intimidad del analizante elementos susceptibles de posibilitar a éste último su reconocimiento en la descripción del caso publicado o a terceras personas el poder identificar a alguien de su entorno familiar, profesional o de sus amigos, lo que puede ser vivido como una violación de su confidencia. Desde el punto de vista de la ley, el paciente habrá sido víctima de intromisión en su intimidad agravado por la violación de secreto profesional del cual es responsable el psicoanalista y podrá entonces ser condenado. En consecuencia, el autor de una publicación de este tipo tiene que tomar todos los recaudos necesarios para evitar toda identificación posible del analizante cuya historia ha sido narrada. |

| Summary, etc. | ZusammenfassungSobald ein Analytiker sich vornimmt, einen Text zu schreiben und zu veröffentlichen, der auf dem Material einer psychoanalytischen Behandlung mit einem seiner Patienten beruht, so muss er dabei sehr vorsichtig sein, da er dem Intimleben des Analysanden Elemente entnimmt, die es letzterem möglicherweise erlauben, sich in der veröffentlichten Falldarstellung wiederzuerkennen, oder es aber Dritten vielleicht ermöglichen könnten, irgendjemanden aus der familiären, freundschaftlichen oder beruflichen Umgebung zu identifizieren, was als Vertrauensmissbrauch erlebt werden kann. In gesetzlicher Hinsicht erleidet der Patient einen Übergriff auf sein Privatleben und fällt darüberhinaus einer Verletzung der Schweigepflicht zum Opfer, der der Analytiker absolut unterliegt und wofür er also verurteilt werden kann,. Der Autor einer solchen Veröffentlichung muss Vorsichtsmaßnahmen treffen, um die Identifizierbarkeit des Analysanden, dessen Geschichte erzählt wird, in jeder Hinsicht zu vermeiden. |

| Summary, etc. | RiassuntoQuando uno picoanalista pensa di scrivere e di pubblicare un testo a partire da un materiale tratto da una cura analitica vissuta con uno dei suoi pazienti, deve far prova di grande prudenza, poichè estrae dall’intimità dell’analizzando degli elementi capaci di permettere a quest’ultimo di riconoscersi nella descrizione del caso pubblicato, o a terzi di identificare un parente, un amico, un collega, il che potrebbe essere vissuto come una violazione della sua confidenza. Il paziente, nei confronti della legge, sarà allora vittima di un attacco alla sua vita privata aggravata da una violazione del segreto professionale al quale è tenuto in modo assoluto lo psicoanalista, che potrà allora essere condannato. E’ necessario quindi che vengano prese delle precauzioni da parte dell’autore di tale pubblicazione onde evitare qualsiasi possibilità di identificazione dell’analizzando di cui viene raccontata la storia. |
