| Summary, etc. | RésuméDans un ouvrage récent, David Leopold s’inscrit en faux contre la thèse, reçue désormais à titre d’évidence, d’une opposition radicale entre la pensée de Marx et les revendications des droits de l’homme. Cette réévaluation stimulante ne suffit pas à dissiper la critique adressée par le jeune Marx aux droits de l’homme critique que ses écrits de maturité radicalisent. On peut cependant, sans prétendre déceler chez l’auteur du Capital une appréciation positive du droit, soutenir que sa pensée souffre sur ce point d’une faiblesse logique. On voit mal, en effet, comment l’émancipation individuelle la visée du communisme selon Marx peut se passer d’une revendication de droit. C’est pourquoi il n’est pas impossible de réinscrire l’intention émancipatrice de Marx, en dépit de Marx lui-même, dans la tradition des droits de l’homme. |

| Summary, etc. | Karl Marx, adversary of human rights ?In a recent publication, David Leopold mounted an attack on a theory long treated as received wisdom : the notion that Marxist thought is radically opposed to human rights claims. This thought-provoking revision is not enough to invalidate Marx’s early critiques of human rights, which became more categorical in his mature writings. Yet we can identify a logical weakness in Marx’s thought on the subject whilst fully recognising that the author of Capital was no positive advocate of rights either. The basic paradox is this : how can individual emancipation – the ultimate goal of communism in Marx’s view – be achieved without rights being claimed ? This question opens the way for a rethinking of Marxist ideas on human emancipation as part of the tradition of human rights – Marx’s own critiques of that tradition notwithstanding. |
