| Summary, etc. | À la Révolution, la loi des 16-24 août 1790 scinde en deux fonctions le parquet d’Ancien Régime des « Gens du Roi ». L’accusateur public, élu de la Nation ou désigné par ses représentants, exerce l’action populaire citoyenne au nom du peuple. Les commissaires du Roi assurent jusqu’au 17 octobre 1792 ce qui relève du pouvoir exécutif : requérir l’application de la loi, faire exécuter les jugements, se pourvoir en cassation, surveiller la conduite des juges. Après le 18 brumaire, la fonction d’accusateur public disparaîtra à son tour, pour ne laisser dans l’histoire de la justice que le triste souvenir de Fouquier-Tinville devant le Tribunal révolutionnaire. Si le tribunal de l’opinion s’est développé depuis, avec notamment la montée de la place des victimes dans le procès pénal, le rôle du ministère public, garant de l’intérêt général, tend à s’affirmer comme un facteur d’équilibre, par un exercice raisonné de l’accusation publique. |

| Summary, etc. | The People as ProsecutorAt the Revolution, the law of 16th-24th August 1790 divided the prosecution service of the Ancien Régime, the « Gens du Roi », into two functions. The public prosecutor, elected by the Nation or chosen by its representatives, conducted proceedings in the name of the people. The King’s Commissioners dealt with matters of executive power until 17 October 1792 : demanding application of the law, enforcing judgements, making appeals and overseeing the conduct of judges. After 18 Brumaire, the role of public prosecutor disappeared in its turn, leaving little more trace in the history of justice than the sorry memory of Fouquier-Tinville before the revolutionary court. Although the court of opinion has developed since then, notably with the growing role of victims in criminal proceedings, the role of the Public Prosecutor’s Office as guardian of the general interest has tended to assert itself as a balancing factor by its reasonable use of public prosecution powers. |
