| Summary, etc. | En confiant la justice de paix à des citoyens juges, les révolutionnaires n’ont fait que reconstruire un modèle de justice que la mode gréco-romaine, qui sévissait alors, avait permis de diffuser dans la société et en particulier chez cette bourgeoisie active qui revendiquait un esprit de liberté économique et de liberté sociale. La justice de paix répondait à leur attente d’un bonheur économique pour une meilleure harmonie sociale. Mais, il est toujours tentant pour le pouvoir politique de chercher à instrumentaliser un tel mode de justice rendu par des non professionnels, selon une procédure rapide et simplifiée, dans un langage proche de celui des justiciables. Concilier, apaiser, arranger, éviter les procès ne demande pas de compétence particulière mais appliquer la loi exige davantage et le rôle des citoyens juges sera tantôt fragilisé en raison des circonstances économiques, tantôt renforcé pour des raisons politiques. |

| Summary, etc. | Citizens as Justices of the PeaceBy entrusting the lay justice system to citizens as justices of the peace, the revolutionaries simply reconstructed a justice system model that the prevailing Greek-Roman fashion of the times had spread through society, and in particular among an active middle class demanding a spirit of economic and social liberty. Justices of the peace met their expectations of economic contentment and improved social harmony. However, it is always tempting for political powers to seek exploit this kind of justice handed down by non-professionals using rapid, simplified procedures in a language similar to that of the parties in proceedings. Reconciling, pacifying, finding arrangements and avoiding lawsuits does not require specific skill but applying the law does, and the role of these citizen judges was sometimes weakened by economic circumstances and sometimes strengthened for political reasons. |
