| Summary, etc. | Au Moyen Âge, la relation que la justice entretient avec l’oubli est beaucoup plus complexe que de nos jours et peut paraître commandée a priori par des impératifs contradictoires. D’une part, l’information reste cloisonnée, et l’immédiateté à laquelle se réfèrent des vies souvent fragiles oblige à une âpre lutte contre l’oubli. Le souvenir d’un crime ne perdure guère et il atteint rarement trois générations chez les hommes ordinaires, soit le temps normal d’une société où prime l’oralité. D’autre part, à l’inverse, les valeurs d’honneur qui structurent la société tout entière, nobles et non-nobles, contribuent à durcir le souvenir de l’offense et engendrent d’autres exigences qui sont celles de la vengeance. Sa menace perdure jusqu’à la fin de l’époque moderne et pèse sur la justice. La question est donc de savoir comment, pour gérer l’oubli, justice et paix sont allées de pair. C’est ce que nous essaierons de démontrer en traitant de l’exemplarité de la peine, tempérée par le recours au pardon que le roi peut aller jusqu’à proclamer comme un oubli total en abolissant le crime. |

| Summary, etc. | In the Middle Ages, there was a much more complex relationship between the law and oblivion than exists today, and at first sight, it may appear to have been dictated by contradictory demands. On the one hand, the information remained compartmentalised and the immediacy characterising people’s often fragile lives required them to engage in a bitter battle against oblivion. The memory of a crime was very fleeting and rarely lasted beyond three generations among ordinary people, which is the normal period for a society in which the oral tradition prevails. On the other hand, and conversely, the honour-based values that structured the entire society – for the nobility and nonnobility alike – contributed to the development of a harder attitude towards offences and led to other demands for vengeance. The threat of the latter persisted until the end of the modern era and exerted an influence on justice. The question, therefore, is to ascertain how, in the management of oblivion, justice went hand-in-hand with peace. This is what we shall be striving to show by considering the exemplary nature of the sentence, tempered by recourse to a pardon, which can be proclaimed by the king as a form of complete oblivion by obliterating the crime. |
