Summary, etc. | « Deffense aux François d’épouser des négresses, cela dégoûterait du service, et deffense aux noirs d’épouser des blanches, c’est une confusion à éviter. » L’article XX de l’ordonnance de Jacob Blanquet de La Haye, vice-roi, amiral et lieutenant pour le Roy dans tous les pays des Indes, pose clairement l’interdiction de l’intermariage à l’île Bourbon en 1674. Cette législation, ignorée dans les débuts du peuplement de la colonie, se voit renforcée par la suite lors du passage d’une société de subsistance à une société esclavagiste. Pourtant, certains sont déterminés à « faire famille » et à déjouer les obstacles juridiques et sociaux mis en place contre ces unions interdites. C’est-à-dire rendre possible la transmission d’un héritage symbolique (patronyme, adoption, éducation) et d’un héritage matériel (biens, dots, testaments). Après un rappel de la législation, ce propos est illustré au travers des détours adoptés par une famille pendant toute la durée de leur vie commune. |

Summary, etc. | “The French are forbidden to marry negresses, which would discourage them from service, and it is forbidden for blacks to marry whites, a confusion to be avoided.” Article 20 of the ordinance of Jacob Blanquet de La Haye, Viceroy, Admiral and King’s Lieutenant for all the Indies, clearly established the ban on inter-marriage on Bourbon Island in 1674. This legislation was ignored in the early days of the settlement of the colony, but was subsequently reinforced when the subsistence society became a society of slavery. Nevertheless, certain inhabitants were determined to “form a family” and circumvent the legal and social hurdles put in place to counter such forbidden unions. In other words, to render possible the passing on of a symbolic heritage (family name, adoption and education), in addition to a material legacy (property, dowry and wills). |
