| Summary, etc. | En Angleterre, au Moyen Âge, l’esclavage était tombé en désuétude, sans formalité juridique.Au xvie siècle, en Angleterre, comme en France, l’esclavage fut réintroduit par les colons européens partis cultiver le sucre et le coton au Nouveau Monde. Les Britanniques sont fiers de leur rôle dans l’abolition de la traite des esclaves africains vers l’Amérique à la fin du xviiie siècle. Mais dès 1705 un procès eut lieu à Londres au sujet de la vente d’un esclave qui se trouvait en Virginie. Le juge, Chief Justice Holt, avait affirmé : “as soon as a Negro comes into England, he becomes free” – « dès qu’un Nègre arrive en Angleterre, il devient libre » –, reprenant la maxime de vieux droit français « nul n’est esclave en France ». |

| Summary, etc. | In the Middle Ages in England, slavery had become obsolete, without any legal formality. In 16th-century England, as in France, slavery was re-introduced by European colonists settling the New World to grow sugar and cotton. The British are proud of their role in the abolition of the African slave trade to America, in the late 18th century. However, as early as 1705, a trial was held in London over the sale of a slave in Virginia. Chief Justice Holt declared: “as soon as a Negro comes into England, he becomes free”, in reference to the motto of old French law, “No man is a slave in France.” |
