| Summary, etc. | L’expression « crime contre l’humanité » peut inciter à relier ce crime au droit international, et en particulier à la Cour pénale internationale, chargée depuis le 1er juillet 2002 de les sanctionner. Les statuts de cette juridiction sont très clairs : elle est incompétente pour connaître des crimes commis avant sa création. En France, un problème particulier se pose pour sanctionner et réparer les crimes résultant de l’esclavage et de la traite négrière transatlantique. En effet, alors que la loi noo2001-434 du 21 mai 2001 qualifie ces infractions de « crimes contre l’humanité », le droit français manque de clarté sur le régime de responsabilité à engager par les descendants d’esclaves afin d’obtenir des réparations. |

| Summary, etc. | The expression “crime against humanity” might serve as a pretext to refer this crime to international law, and in particular to the International Criminal Court, which has been responsible for punishing such crimes since 1st July 2002. However, the statutes of this court are very clear: it is not within its jurisdiction to recognise crimes committed before its creation. In France, a specific problem arises with regard to punishment and reparation for crimes resulting from slavery and the trans-Atlantic slave trade. While Law No 2001-434 of 21 May 2001 qualifies these offences as “crimes against humanity”, French law lacks clarity on the form of liability to be invoked by descendants of slaves seeking reparation. |
