Summary, etc. Parmi la centaine d’erreurs judiciaires reconnues au cours du xixe siècle, quelques-unes seulement ont eu un retentissement considérable dans la presse et l’opinion. Alors, la figure de martyr du condamné innocent et la campagne d’opinion dont il est l’objet mettent à l’ordre du jour la nécessité de réformes restées jusque-là à l’état de projets. La réforme dans un sens libéral de la procédure de révision – possibilité après décès du condamné (1867), prise en compte du fait nouveau (1895) – doit beaucoup au combat d’innocents condamnés et à leurs soutiens (héritiers Lesurques, affaires Pierre Vaux et Borras). Plus encore, c’est dans le sillage de quelques « scandales judiciaires » qu’est fortement contestée une instruction de type inquisitorial : la réforme de l’interdiction de communiquer (1865) et surtout la loi Constans (1897), faisant une place au principe du contradictoire, confirme que le progrès des libertés en matière de procédure pénale se fait souvent dans la douleur de l’erreur judiciaire.

Summary, etc. Of the hundred or so judicial errors recognised in the course of the 19th century, only a few made a considerable impact in the press and on public opinion. In those that did, however, the figure of the martyred innocent prisoner and the public opinion campaign around them highlighted the need for reforms that hitherto had failed to go beyond the project phase. The reform of the review procedure in a more liberal direction – the possibility of judicial review after the convict’s death (1867), the consideration of new evidence (1895) – owes a good deal to the struggles of innocent convicts and their supporters (such as the case of the Lesurques heirs or the Pierre Vaux and Borras affairs). Moreover, it was in the wake of certain “judicial scandals” that the inquisitorial type of investigation became strongly contested : the reform of incommunicado detention (1865) and especially the Constans law (1897), which enshrined the principle of inter partes proceedings, are both illustrations of how the progressive development of civil liberties in the field of criminal procedure has often had a painful birth in judicial error.
