Summary, etc. | La main de justice, second sceptre des rois de France, apparaît au xiiie siècle comme instrument du sacre des rois capétiens. Au même titre que l’ensemble des regalia, elle est aussitôt reprise dans les représentations royales, et ce dans la diversité de leurs supports. Ce n’est pourtant pas à ce seul titre que la main de justice participe de l’affirmation de la souveraineté royale à la fin du Moyen Âge, puisque la main de justice – ou « main du roi » – renvoie aussi à une procédure dont l’usage s’affine tout au long du xive siècle, celle du séquestre judiciaire. Si l’évolution de cette procédure a bien été étudiée par les historiens du droit, cette étude s’attache plus précisément à comprendre le sens de l’apparition et de l’utilisation conjointe de la main comme sceptre et de la main comme procédure dans l’exercice concret de la justice royale, à partir des archives médiévales du parlement de Paris. |

Summary, etc. | The Hand of Justice, the second scepter of the kings of France, appeared in the 13th century as an instrument of the coronation of the Capetian kings. Like all the regalia, it was immediately used in royal representations. However, this was not the only way in which the hand of justice contributed to the assertion of royal sovereignty at the end of the Middle Ages, since the hand of justice – or “hand of the king” – also referred to a procedure whose use was refined throughout the 14th century, that of judicial sequestration. While the development of this procedure has been well studied by legal historians, this study focuses more specifically on understanding the significance of the emergence and use of both the hands, as a sceptre and as a procedure, in the practical exercise of royal justice, based on the medieval archives of the parlement of Paris. |
