| Summary, etc. | Dès 1915, la priorité française donnée à la récupération des effectifs au profit de l’armée et de l’économie de guerre a nourri la suspicion qu’un grand nombre de malades ou de blessés, soignés dans les formations du Service de Santé militaire, se dérobaient à leur devoir militaire en refusant des traitements ou des opérations. Confortée par la découverte de cas de mutilations ou d’intoxications volontaires, cette présomption d’indignité militaire a poussé certains médecins à commettre des abus pour démasquer les « simulateurs », tout en provoquant chez les malades et blessés des attitudes très diverses, allant de la soumission à l’insubordination en passant par la simulation ou le recours à de multiples stratagèmes. De là une spirale du zèle contre l’évitement qui se serait sans doute discrètement prolongée jusqu’à la fin du conflit, si les premiers procès pour refus de traitement ou d’opération n’avaient suscité, dès l’été 1916, une vive polémique autour des droits des blessés. La nécessité de calmer cette polémique, préjudiciable au rendement de la récupération, a alors conduit la direction du Service de Santé à inventer des arrangements qui permirent non seulement d’éviter une chasse - politiquement embarrassante - aux « simulateurs », mais aussi de sauvegarder un certain équilibre entre les droits des blessés et les intérêts d’une nation en guerre. |

A casuistry of war (1914- 1918) In 1915 the French government’s desire to increase the size of the army and war economy led to the grave suspicion that many of the sick or injured, treated in the healthcare service units, were shirking their military duty by refusing treatment or operations intended to hasten their return to the army. This idea was reinforced by the discovery of cases involving self-inflicted injuries and self-poisoning, and this suspicion of military unworthiness has led some doctors to commit abuses in order to unmask the “malingerers”, and has at the same time provoked different attitudes among the sick and injured, ranging from submission to insubordination, and from malingering to resorting to various other schemes. But it has also raised in many quarters (Undersecretary of State for the Health Service and advisory bodies, medical, experts and learned societies, committees and Chamber of Deputies), “arrangements”, which allowed not only politically embarrassing manhunts of the malingerers or endless convictions to be avoided, but also allowed a balance to be maintained between the rights of the injured and the interests of the nation at war. |
