| Summary, etc. | Les droits de l’homme à l’époque de la guerre du Viêt-NamLe souvenir du second conflit mondial étant resté vivace pendant la guerre du Viêt-Nam, les opposants à celle-ci ont souvent fait référence aux procès de Nuremberg et Tokyo. Cette critique n’eut pas d’effets judiciaires, car le droit humanitaire international alors en vigueur comprenait de nombreuses échappatoires. En revanche, le thème des droits de l’homme a nui politiquement aux États-Unis et au Sud Viêt-Nam, qui pratiquaient une violence massive, difficile à cacher, et a profité au Nord Viêt-Nam et au FNL, dont les exactions étaient ciblées et discrètes. Mais peu après la fin du conflit, la distinction entre « autoritarisme » et « totalitarisme » permit à la droite américaine de reprendre à son compte le thème des droits de l’homme, pour justifier de nouvelles interventions militaires à l’étranger. |

| Summary, etc. | Les droits de l’homme à l’époque de la guerre du Viêt-NamAs the memory of World War II was still fresh during the Vietnam war, pacifists often referred to the Nuremberg and Tokyo trials. This line of criticism had no judicial consequences, for the international humanitarian law then in force contained many escape clauses. Nevertheless, the theme of human rights had political consequences : it placed the open, massive violence of South Vietnam and the United States in a bad light, whereas the quiet terrorism of North Vietnam and the NLF passed muster. Yet, soon after the end of the war, with the distinction between « authoritarianism » and « totalitarianism », American conservatives found a new rationale for military interventions abroad, in the name of human rights. |
