| Summary, etc. | La pérennité de la définition de la propriété dans le Code civil contraste avec l’évolution de son contenu. La promotion de l’intérêt individuel se voit aujourd’hui opposer la protection de l’intérêt collectif avec une nouvelle vigueur. À supposer que la conciliation des deux puisse se faire dans le champ juridique du droit de propriété, il faut penser une évolution de son régime autrement que par la promotion d’une forme de collectivisation des biens, qui fut historiquement la première proposition. Il est proposé de réfléchir à l’articulation des droits du propriétaire avec ceux des tiers par la technique des droits réels, du contrat et de l’affectation. Pour dépasser la problématique de la propriété collective, ces dernières décennies, la mise en lumière du patrimoine d’affectation a également été promue avec la volonté d’instituer et de formaliser la recherche de communs auxquels les propriétaires sont parties prenantes aux côtés d’autres détenteurs de droits. |

| Summary, etc. | The sustainability of the property rights enounced in the Civil Code contrasts with the evolution of its content. The promotion of self-interest is seen today in opposition to the protection of the public interest. This contradiction in the legal field of property rights, must be better overriden an adaptation of its legal regime than the promotion the collectivization of property, which was historically the first proposal. It is proposed to consider the possible articulation of the property rights of the owner with those of a third interest (stakeholder) by the technique of real rights, contract and allocation of goods. To overcome the problem of collective ownership in recent decades, the commons, and world heritage allocation was promoted. These concepts underline the desire to establish and formalize the search for common engaging owners as stakeholders alongside. |
