| Summary, etc. | Les notions d’entreprise et de subordination permettaient au juge d’isoler l’employeur au sein de l’organisation complexe des entreprises. Mais l’évolution de la notion d’entreprise a engendré l’écroulement des constructions jurisprudentielles qui servaient à établir l’existence d’un contrat de travail et par voie de conséquence à identifier l’employeur. Ce problème menace le droit du travail dans ses fondements. Pour y remédier, nous proposons dans cette étude une définition dynamique de la notion d’employeur, plus ouverte à une reconnaissance de la dépendance économique. |

| Summary, etc. | Business concepts and subordination allowed the judge to isolate the employer inside the complex business organization. However, the evolution of the concept of business has brought about the collapse of jurisprudential constructions which served to establish the existence of an employment contract and consequently to identify the employer. This problem threatens the labour law to its foundations. To remedy this we propose in this study a dynamic definition of the concept of employer and a plea for more recognition of the economic dependence. |
