| Summary, etc. | Le statut des arrêts de la Cour commune de justice et d’arbitrage (CCJA) et des sentences arbitrales rendues sous son égide a été perçu par les juristes comme l’étoile de Noël annonçant une ère nouvelle. Pourtant, le bilan à ce jour montre que le régime de la circulation des titres exécutoires nationaux dans l’espace OHADA va à l’encontre des finalités d’intégration et de sécurité juridique et judiciaire visées. Il trahit, d’une part, des relents souverainistes et, d’autre part des incohérences diverses qui freinent les objectifs de l’OHADA.L’hypothèse de l’auteur est qu’un encadrement pragmatique de la libre circulation des titres exécutoires dans un espace intégré serait un gage de sécurité juridique et d’une plus grande confiance entre les États. Conscient de ce que la suppression de l’exequatur a des effets ambivalents, il propose des pistes pour une minimalisation maîtrisée des procédures intermédiaires, prenant en compte l’équilibre des intérêts des parties. Il s’agirait d’un pas décisif vers la sécurisation du climat des affaires et la création d’un marché commun contribuant à l’unité africaine, finalités souvent occultées de l’OHADA. |

A look at the current situation and the prospects of a contrasting developmentThe status of judgments delivered by the Common Court of Justice and Arbitration (CCJA) and awards of arbitration under its auspices have been perceived by jurists as the Christmas star ushering in a new era. However, an assessment of the present context reveals that the system of circulation of national enforceable acts in the OHADA (Organisation for the Harmonization of Business Law in Africa) space goes against the goals of integration and legal and judicial security. The system highlights sovereigntist trends and inconsistencies that hinder the objectives of OHADA.The author hypothesizes that a pragmatic framework for the free circulation of enforceable acts in an integrated area would be a guarantee of legal security and greater confidence between states. Conscious of the fact that the abolition of exequatur has ambivalent effects, he proposes ways for a controlled streamlining of intermediate procedures that balances the interests of the parties. This would be a decisive step toward securing the business climate and the creation of a common market, thereby contributing to African unity, these all being the underlying goals of OHADA. |
