| Summary, etc. | La fragmentation juridique des mers et des océans n’est pas le fruit de la géographie et des géomorphologies marines mais celui du rapport entre les États et les espaces maritimes. Ce rapport traduit tout d’abord l’emprise des États sur la mer, en leur qualité d’État côtier ou d’État du pavillon, une emprise qui sert avant tout leurs intérêts particuliers. Il illustre également une tentative, encore limitée et timide, vers un dépassement desdits intérêts étatiques au bénéfice de l’humanité tout entière. |

| Summary, etc. | The legal fragmentation of seas and oceans is the result of relationships between states and maritime spaces, rather than a matter of geography and marine geomorphology. First and foremost, this report reflects the power states hold over the sea in their capacity as coastal or flag states – a power that primarily serves their own specific interests. It also illustrates an attempt (admittedly one that is both limited and timid) to move beyond these state interests, towards the benefit of humanity as a whole. |
