Responder a esta pregunta es menos sencillo de lo que parece y requiere asumir tres desafíos: absorber el conocimiento estadístico de este fenómeno, comprender su dimensión política y, por último, entender el contenido jurídico de las normas nacionales e internacionales producidas en este ámbito. Esta contribución pone de manifiesto la diversidad de enfoques posibles para comprender el tema, pero también las lagunas jurídicas que pueden existir en este ámbito. La presente contribución propone hacer un balance sobre el estado del Derecho y sobre las perspectivas de evolución posibles. |
