| Summary, etc. | L’Éthique est antérieure au droit, elle l’inspire, le prolonge, mais conserve aussi son autonomie. Un État de droit et une démocratie imposent le respect et la confiance dans le droit et la justice auxquels participent les professionnels du droit. Ces professions à statuts respectent une éthique professionnelle. Ainsi, les impératifs communs des magistrats et avocats permettent de comprendre le sens des règles déontologiques que sont l’indépendance, la notion de conflit d’intérêts, l’impartialité, l’intégrité, le secret, la probité, le respect d’autrui, la dignité, la conscience… En dépit de la spécificité de chaque profession, l’Éthique demeure la boussole des comportements professionnels dans l’intérêt du Droit et de la Personne afin de garantir les libertés et la confiance que celle-ci doit avoir dans les institutions. |
