Summary, etc. | Despite the democratic changes in the early 90s, instances of disruption to the constitutional order have been widespread across the African continent. Since then, no institutional mechanism has been able to regulate this phenomenon. This article asks what happens when the Constitution is suspended, the institutions dissolved, and the political regime revoked. Two theses are usually considered: the thesis of lawlessness and the decisionist thesis. In a previous article, I formulated the hypothesis of a third way imposed by reality; an alternative constitutionalism that I theorize under the name of “transitional constitutional law.” Having already developed the normative aspect of this law, this article aims to delve beyond the question of legitimacy to analyze the legal logics of these transitional institutions. |

Summary, etc. | Malgré l’ouverture démocratique des années 1990, les situations de perturbation de l’ordre constitutionnel sur le continent africain sont abondantes. Le droit constitutionnel est pris en défaut devant un tel phénomène : les théories, institutions et dispositifs classiques sont impuissants, non seulement à régir de telles situations, mais aussi à les expliquer. La présente contribution tente de répondre à une question : que se passe-t-il lorsque pour une raison ou pour une autre la Constitution est suspendue, les institutions dissoutes et le régime politique révoqué ? Autour de cette question, deux thèses classiques s’affrontent : la thèse du non-droit et la thèse décisionniste. L’auteur explore une troisième voie dictée par la réalité : celle d’un constitutionnalisme alternatif, qu’il a récemment théorisé sous la notion de « droit constitutionnel transitionnel ». Ayant déjà développé dans un article l’aspect normatif de ce droit, il s’intéresse dans la présente contribution aux institutions de transition, pour saisir au-delà de la question de leur légitimité, celle de leurs logiques juridiques. |
