| Summary, etc. | La Communauté Économique des États de l’Afrique de l’Ouest (CEDEAO) a toujours nourri l’ambition de construire un marché commun des investissements susceptible de stimuler le flux des investissements dans la région. Or, l’édification d’un tel marché commande la production de normes communautaires d’investissement. Cette communauté économique régionale s’est alors engagée dans un processus d’harmonisation des règles et politiques d’investissement de ses États membres, lequel s’est soldé par l’adoption, en 2008, de l’Acte additionnel portant sur les règles communautaires d’investissement et leurs modalités d’application. Une décennie plus tard, attentive aux évolutions économiques et socio-politiques dans ses États membres, la CEDEAO va adopter un Code communautaire des investissements : l’ECOWIC. La présente étude ambitionne de décrypter les aspects substantiels des nouveautés apportées par ce nouvel instrument juridique d’investissement. De par ses dispositions novatrices, l’ECOWIC marque une rupture avec les accords internationaux d’investissement « à l’ancienne » et mérite dès lors une attention particulière. |

| Summary, etc. | It has always been the ambition of the Economic Community of West African States (ECOWAS) to build a common investment market capable of stimulating investment flows in the region. But the construction of such a market requires an enactment of communitarian investment rules. This regional economic community then embarked on a process of harmonization of its Member States’ investment rules and policies, which resulted in the conclusion of the 2008 Supplementary Act adopting community rules on investment and rules, and the modalities of their implementation. A decade later, attentive to the economic and socio – political developments in its Member States, the ECOWAS adopted a common investment Code : the ECOWIC. The present paper aims to analyze the substantial aspects of the novelties brought by this new investment legal instrument. With its innovative provisions, the ECOWIC marks a departure from the ‘ old-style’ international investment agreements and thus deserves a special attention. |
