| Summary, etc. | Devant l’appel à un changement de paradigme en droit, il importe de savoir si une révolution scientifique est en cours pour penser les transformations contemporaines du phénomène normatif. Le présent article est fondé sur l’hypothèse que la recherche d’un nouveau paradigme n’est pas nécessaire, puisque la cybernétique qui s’élabore depuis plusieurs décennies se trouve déjà en arrière-plan du droit. En examinant certaines théories du droit récemment élaborées, il est possible en effet de montrer que celles-ci sont fondées, souvent expressément parfois implicitement, sur les concepts définis par cette « nouvelle science ». La généalogie de trois théories est ici présentée : la théorie des systèmes, la théorie du réseau et la théorie génétique du droit. |

| Summary, etc. | Faced with the call for a paradigm shift in law, it is important to know whether a scientific revolution is underway to think about the contemporary transformations of the normative phenomenon. This article is based on the assumption that the search for a new paradigm is not necessary, since the cybernetics that has been developing for several decades is already in the background of the law. By examining certain theories of law recently developed, it is indeed possible to show that they are founded, often expressly sometimes implicitly, on the concepts defined by this « new science ». The genealogy of three theories is presented here : systems theory, network theory and genetic theory of law. |
