| Summary, etc. | Dans la tourmente des bombes à Gaza et des accusations de propagande diabolisant le frère ennemi israélien ou palestinien, le droit international tente modestement de contenir la violence par les régulations du jus ad bellum et du jus in bello . S'agissant des exactions commises sur le terrain, seul le recours à un tribunal international impartial permettrait de les qualifier juridiquement . En effet, tout génocide supposant une « intention de détruire… un groupe national, ethnique, racial ou religieux (…) », comment, sans l'interprétation d'un juge de bonne foi, déterminer concrètement si Israël ou le Hamas (ou les deux) s'en est rendu coupable ? Encore faudrait-il un consensus pour saisir une juridiction… |

| Summary, etc. | To face the sound and fury of arms and propaganda raised in Gaza by the brothers enemies – israelians and palestinians –, International Law can humbly oppose its own weapons, that is the laws of war, trying thereby to contain violence. But only an impartial tribunal could provide for adequate qualifications of the acts of violence perpetrated there by Israel and the Hamas. Since the infraction of genocide requires a specific « intention to destroy, in whole or in part, a national, ethnical, racial or religious group as such », a bona fide interpretation by a jurisdictional body is necessary to elucidate in concreto this issue. It remains however doubtful whether both belligerents would agree to submit the case to an international tribunal. |
