| Summary, etc. | L’objectif de réduction des émissions de gaz à effet de serre des Pays-Bas n’étant pas conforme au devoir de diligence de l’État en matière climatique, celui-ci doit être rehaussé pour atteindre -25 % en 2020 par rapport à 1990, conformément à l’état des connaissances scientifiques et des décisions adoptées par la Conférence des parties à la Convention-cadre des Nations unies sur les changements climatiques en 2010. C’est en substance ce qu’indique la Cour du District de La Haye dans l’affaire opposant l’ONG Urgenda aux Pays-Bas et qui marque un tournant de la justice climatique. Bien que sa portée directe soit limitée à la politique d’atténuation des changements climatiques des Pays-Bas à l’horizon 2020, cette décision participe à la fois à la subjectivisation des acteurs de la justice climatique et à l’objectivisation de la responsabilité qui en découle, ouvrant la voie à un « dialogue des juges » et une possible influence sur les négociations internationales en cours. |

| Summary, etc. | The greenhouse gases emission reduction target of the Netherlands violating the duty of care of the State in relation to climate change, it has to be elevated to reach at least -25 % in 2020 compared to 1990, in accordance with the latest scientific knowledge and decisions adopted by the Conference of the parties to the United Nations Framework Convention on climate change in 2010. This is in substance what states the District Court of the Hague in this case opposing the NGO Urgenda and the Netherlands and which marks a turning point of climate justice. Although limited to the mitigation policy of the Netherlands up to 2020, this ruling participates to the subjectivization of climate justice actors but also to the objectivization of associated liability, opening the way for a “dialogue of judges” and a possible influence on current international negotiations. |
