| Summary, etc. | Du mouvement de l’air, au cycle de l’eau, en passant par la migration des espèces, une marée noire ou les mouvements transfrontières de déchets, le droit de l’environnement s’accorde avec un réel mouvant en perpétuel changement. Les mouvements de l’environnement sont saisis par le droit grâce à des mots, concepts ou catégories juridiques qui reflètent plus ou moins fidèlement la réalité environnementale. L’appréhension juridique de l’environnement s’éloigne parfois de la complexité du réel, révélant ainsi le caractère performatif du droit. Face à cet objet évolutif qu’est l’environnement, le droit évolue et se conceptualise dans un premier temps en réaction à son objet, puis progressivement la matière dépasse une approche empirique de son objet pour se construire plus durablement. |

| Summary, etc. | From air movement to hydrological cycle, through migration of species, oil slick or transboundary movements of wastes, environmental law deals with a moving reality in constant change. The law handles the environmental movements with words, concepts or juridical categories reflecting more or less the environmental reality. Nevertheless, the law often diverges from the complexity of reality, revealing its performative nature. Confronted with this moving environment, the law evolves. First, it is conceptualized in accordance with its object. Then, it goes beyond an empirical approach to turn into a more mature and durable system. |
