| Summary, etc. | Éthique et droit de l’environnement, sans sacraliser la nature, travaillent à l’élaboration d’un nouveau pacte homme-nature, liant conscience forte d’une appartenance et exigence de responsabilité. Il s’agit de trouver un nouvel équilibre entre l’environnement, la valeur et la loi, élaborant un nouveau régime interprétatif et une compréhension renouvelée de l’homme. Ce pacte de soin est celui qui sous-tend une pensée formulée en termes positifs de « contrat naturel », même si l’expression est sans doute malheureuse. Le rôle du droit de ce point de vue n’est-il pas de reprendre dans le champ des décisions pratiques et des arrêts positivement exprimés le sens retrouvé de nos appartenances ? Ne cherche-t-il pas à mettre un terme, au nom de la valeur reconnue à la relation homme-nature, la fragmentation infinie de la nature qui prépare son instrumentation technique ? |
