| Summary, etc. | Le mouvement de l’eau dans une approche globale, c’est-à-dire dans sa conception cyclique, est relativement récent en droit. Les relations étroites qu’entretiennent désormais le droit et le cycle hydrologique expliquent qu’une conception juridique de l’eau, plus globale et moins parcellaire, émerge et aboutisse progressivement à un changement de paradigme. Là où l’eau faisait exclusivement l’objet d’un usage pour satisfaire des activités anthropiques, elle bénéficie désormais d’une protection, plus ou moins forte, en raison de son caractère essentiel pour le maintien de la vie, lequel est conditionné par la réalisation du cycle de l’eau. L’appréhension juridique de l’eau se confond donc progressivement avec le processus naturel dont les nécessités de protection imposent l’application de la réglementation. |
