| Summary, etc. | La reconnaissance d’une qualification universellement reconnue comme « patrimoine commun de l’Humanité » ou « bien public mondial » pour des ressources ou des biens d’intérêt partagé par tous les êtres humains se heurte à un conflit de valeurs et de normes. Alors que la conservation de ces ressources ou biens se révèle comme une finalité pour certains États, parmi les pays occidentaux, elle représente pour d’autres pays un vecteur de développement à exploiter. La mise en valeur du « patrimoine commun », naturel ou culturel, étant perçue différemment d’un continent à l’autre, ces différences retardent la mise en place d’un régime international de gestion, pourtant souhaitable, des « biens communs mondiaux ». S’en remettre aux régimes de responsabilité propres à chacun des pays et constater l’éparpillement des solutions n’est guère satisfaisant. Dans la mesure où un risque de réservation au profit de quelques-uns de ces « biens communs », comme du savoir acquis dessus, est omniprésent, leur gestion dans l’intérêt des générations à venir suppose d’identifier clairement les conditions de la mise en jeu de la responsabilité de l’auteur d’excès ou d’abus dans l’accès ou l’utilisation de ces « biens ». Cette gestion devrait passer par la qualification juridique de chose commune et par la création, en France, d’un régime spécial de responsabilité adapté, sur le modèle de la réparation du préjudice écologique pur1. |

| Summary, etc. | Which civil liability regime for the damaged common goods? The recognition of a qualification universally recognized as «common heritage of the Humanity» or «global public resource» for resources or the properties of interest shared by all the human beings comes up against a conflict of values and of standards. While the preservation of these resources or properties proves to be a purpose for some States, among the western countries, it represents for other countries a vector of development to maximize. The development of the natural or cultural «common heritage», differently viewed from a continent to another, these differences delay the international management system of “global public resources”, nevertheless desirable. It would not appear acceptable to rely on each liability regime countries and to notice the dispersal of the solutions. In so far as there is a risk of reservation for the benefit of some of these «global properties», their management requires clear identification of perpetrator liability in cases of misuse of these properties. This management should be done in connection with legal qualification of “common to all” and with the creation of a French special liability system based on the compensation of ecological damage. |
