| Summary, etc. | La loi n˚ 2010-2 du 5 janvier 2010 relative à la reconnaissance et à l’indemnisation des victimes des essais nucléaires français, dite loi « Morin » a institué un régime légal d’indemnisation des victimes de ces essais fonctionnant avec une présomption de causalité. Toutefois, ce mécanisme d’indemnisation se heurte en pratique à la facilité avec laquelle l’administration peut renverser cette présomption légale. Par les trois arrêts commentés, rendus le 7 décembre 2015, le Conseil d’État a entendu encadrer le renversement de cette présomption par l’administration et replacer le juge dans son rôle de contrôle. |

| Summary, etc. | The reversal of the presumption of causality of the “Morin” law for the victims of nuclear testsThe law n˚2010-2 of January 5th of 2010 on the recognition and compensation of the victims of French nuclear tests (Morin law), created a legal framework of victim’s compensation based on the presumption of causality. However, in practice this mechanism can easily be reversed by the administration. With three decisions of December 7th of 2015, the supreme administrative court has showed its will to regulate the reversal of this presumption and to give the judges their real mission of control. |
