| Summary, etc. | La chronique traite des arrêts de la Cour de justice et du Tribunal de l’UE portant sur le droit de l’UE des pollutions et nuisances rendus en 2016. À une exception près toutefois, puisqu’elle revient également sur l’arrêt du Tribunal de l’UE du 16 décembre 2015 (arrêt « biocides »), arrêt notable dans la mesure où il rappelle les obligations d’agir de la Commission en la matière. La jurisprudence de l’année 2016 confirme l’importance de contentieux classiques, tels que celui de l’interprétation de la législation sur l’eau ou les déchets, que ce soit dans le cadre de la procédure préjudicielle ou de la procédure en manquement. Elle conforte aussi la montée en puissance des enjeux de l’encadrement procédural des acteurs de la mise en œuvre du droit de l’Union, que ce soit la Commission elle-même ou les autorités nationales. L’effectivité du droit d’accès à l’information dans le champ des pollutions et nuisances est centrale pour renforcer leur contrôle, elle est d’ailleurs confortée par le positionnement très favorable du juge de l’Union. |

| Summary, etc. | This contribution deals with the 2016 case law of the European Court of Justice and the General Court, related to the interpretation and enforcement of EU legislation on pollution and nuisances. However with one exception, since it also mentions the 16 December 2015 ruling adopted by the General Court (biocides case). It is of a particular interest since it stresses the obligations to act imposed on the Commission in this particular field. The 2016 case law expresses the importance of classical litigation such as the one relating to the interpretation of the EU legislation on water or on wastes, in preliminary proceedings and infringement actions. Furthermore, are strengthened the issues of the procedural framework applicable to the key actors for the enforcement of EU legislation, namely the Commission itself or the national authorities. The effectiveness of the right to access to information in the field of pollutions and nuisances is indeed a core issue to support the review process of action of public authorities, which is encouraged by the protective conception of the right to access to information promoted by the European judge. |
