| Summary, etc. | La conscience des enjeux environnementaux globaux au niveau européen a conduit à l’intégration progressive, dans le cadre des politiques « traditionnelles » de l’Union européenne, d’une dimension environnementale dotée d’un potentiel inédit de normes de soft law, se présentant comme une alternative diplomatique au droit répressif européen de l’environnement. Le développement de cette « diplomatie environnementale » de l’Union européenne évoque l’hypothèse d’une mutation du cadre juridique habituel pour mieux servir cette nouvelle orientation de l’Union, dans le but de fournir des réponses globales et transversales aux problèmes surgis. La viabilité et l’effectivité de ce processus dépend notamment des capacités des acteurs impliqués à tirer profit d’un arsenal juridique polymorphe, adapté en l’occurrence à la spécificité des besoins en matière environnementale, afin de mener à bien une action politique et juridique cohérente dans ce domaine. |

| Summary, etc. | The awareness of global environmental issues at a European level has led to the gradual integration, within the framework of the EU’s "traditional" policies, of an environmental dimension. This dimension is endowed with an unprecedented potential of soft law norms, presented as the diplomatic alternative to the European repressive environmental law. The development of this "environmental diplomacy" of the European Union evokes the hypothesis of a change in the usual legal framework to better serve its new direction, with the aim of providing comprehensive and transversal answers to the arising problems. The viability and effectiveness of this process depends in particular on the capacities of the actors involved to take advantage of a polymorphic legal arsenal, adapted in this case to the specific nature of environmental needs, in order to carry out a coherent political and legal action in this field. |
