| Summary, etc. | L’autorisation environnementale est issue de l’ordonnance du 26 janvier 2017 et est codifiée dans le Code de l’environnement. Elle traduit la volonté de réduire à une seule, au lieu d’une pluralité, le nombre d’autorisations nécessaires à un porteur de projets pour lancer son activité. Ce nouveau mécanisme a donc été présenté par le ministère de l’Environnement comme étant un outil de simplification du droit. L’objet de cet article est d’approfondir la réforme pour savoir si l’on peut réellement qualifier ce mécanisme comme tel. Or, beaucoup plus subtile à manier qu’elle n’y paraît au premier abord, la simplification du droit suppose de poser le bon diagnostic sur le droit positif, de façon à appliquer le bon remède. Il n’est pas certain que tel fut le cas pour l’autorisation environnementale, dont l’application est d’ailleurs source de nouvelles difficultés. |

| Summary, etc. | The environmental permit comes from the Ordinance of the 26th January 2017, codified into the Environmental Code. It aims at having only one of authorisation to be required to launch a project instead of several ones. This new mechanism was presented by the Ministry of the Environment as a tool for simplification of Law. The purpose of this article is to develop the reform in order to check whether this mechanism can be really regarded as a tool for simplification of Law. Indeed, the simplification of Law is a difficult exercise and suppose to establish the adequate diagnostic about applicable lawin order to adopt the proper remedy. It looks uncertain in respect of environmental permit, whose enforcement is source of difficulties. |
