| Summary, etc. | Cette nouvelle chronique couvre la période allant de juillet 2017 à juin 2018. Compte tenu du nombre raisonnable de décisions du Conseil d’État et de la Cour de cassation faisant application de la Charte de l’environnement, les auteurs ont fait le choix d’un traitement exhaustif quoique limité aux juridictions suprêmes des deux ordres de juridiction. Devant le juge administratif, le contentieux porte toujours, majoritairement, sur les articles 5 et 7 de la Charte. Il y a surtout eu, sur la période couverte, des décisions de confirmation et des décisions d’espèce. On n’identifie pas de véritables décisions de principe, sauf sur un aspect précis de l’articulation entre la participation du public et la consultation de certains organismes. Devant le juge judiciaire, le contentieux porte sur les articles 1er, 4 et 5 de la Charte. Deux des trois décisions ont été l’occasion pour les requérants de poser une question préjudicielle, sur la conformité d’une règle de procédure pénale d’abord, et d’une règle d’urbanisme ensuite, au regard de la Charte de l’environnement. La dernière des trois décisions s’inscrit, quant à l’invocation de la Charte, dans la lignée classique de la jurisprudence du juge judiciaire sur l’obligation d’information délivrée au public, même si l’on peut regretter le manque d’audace du juge au regard de l’information particulière en cause. |
