| Summary, etc. | Le constat d’altération sans précédent de la biodiversité dans un contexte d’anthropisation continue de la planète a conduit la loi du 8 août 2016 relative à la reconquête de la biodiversité, de la nature et des paysages à se fixer un objectif ambitieux : sauvegarder le vivant, la biodiversité dans toutes ses composantes. Pour cela, elle a dû, entre autres, renouveler les principes d’action qui doivent permettre sa préservation ou sa restauration, et même en « créer » ou en reconnaître de nouveaux.Il en est ainsi du principe de solidarité écologique, proposant une vision dynamique de la biodiversité mise en évidence par les recherches et les travaux de scientifiques, soulignant l’importance des interactions et interdépendances entre protection de la nature et activités humaines. Reconnu comme principe général du droit de l’environnement, mais aussi par sa formulation dans le Code de l’environnement, il a vocation à être territorialisé, donc à devenir effectif.L’intérêt de ce principe éthique va certainement au-delà de son applicabilité car il devrait permettre de dépasser la confrontation entre droits de l’Homme et droits de la nature, de concilier approche anthropocentrée et écocentrée dans un souci de « continuité de l’existence de l’humanité ». |

| Summary, etc. | The observation of an unprecedented alteration of the biodiversity in a continuous anthropization context lead the 8th August 2016 Act related to the restoration of biodiversity, nature and landscapes to set an ambitious target : save the living being and the biodiversity in all its parts. In that purpose, this Law had to renew its policy principles in order to provide the preservation and the recognition of new ones.The Ecological Solidarity Principle is an example by suggesting a dynamic vision of the biodiversity thanks to the scientific research and by enlightening interactions and interdependencies between protection of the nature and human activities. Recognized as a general principle of Environmental Law, this principle is intended to get a territorial nature and become therefor efficient.The interest of this ethical principle goes certainly further its applicability. It should indeed provide to move beyond confrontation between Human Rights and Rights of Nature, to reconcile anthropocentric and ecocentric approaches for the sake of "continuity of humankind existence". |
