| Summary, etc. | Depuis son apparition en 1976, cette notion n’a pas fait l’objet d’un réel effort de définition juridique mais présente une certaine polysémie selon les textes qui la mentionnent. Elle est donc difficile à manier en matière contentieuse. Il appartient au juge administratif d’apprécier sa portée au vu des éléments de fait qui lui sont soumis tout en utilisant les novations récemment apportées au contentieux administratif. La prise en compte du droit de l’Union européenne et de notions de droit souple donne de nouvelles perspectives au contrôle opéré par les tribunaux. Il en est de même des possibilités de régularisation des décisions administratives en matière d’environnement. |

| Summary, etc. | Since its appearance in 1976, this notion has not been the subject of a real effort of legal definition but presents a certain polysemy according to the texts that mention it. It is therefore difficult to handle in litigation. It is up to the administrative judge to assess its scope in view of the facts submitted to him while using the recent innovations in administrative litigation. Taking account of European Union Law and flexible legal concepts gives new perspectives to the control exercised by the courts. The same is true of the possibility of regularizing administrative decisions in the environmental field. |
