Tel est le mot qui ressort des discours au soir du processus « vers un pacte mondial pour l’environnement » engagé par les Nations unies en mai 2018 et qui s’est achevé le 23 mai 2019. La décision du Groupe de Travail d’abandonner l’idée d’un pacte mondial, juridiquement contraignant, pour une déclaration politique non contraignante, a suscité un profond malaise au sein de la société civile et de bon nombre d’instances gouvernementales qui semblaient y avoir fondé tant d’espoirs. Mais est-il judicieux de parler d’« échec » du processus ? « Naufrage » ! Tel est le mot que nous proposons. Sur la forme, le processus était moins susceptible d’aboutir du fait de sa rapidité, du choix du consensus comme mode de décision, du contexte géopolitique moins favorable et des diplomates qui devaient se prononcer sur des questions juridiques fondamentales encore en débat dans les milieux scientifiques. Sur le fond, il s’agissait de se prononcer sur la nécessité d’un pacte mondial pour faire face aux lacunes du droit international de l’environnement et des textes relatifs à l’environnement. Mais avant, il fallait d’abord s’accorder sur la notion de lacune en droit. Le « naufrage » traduit également les possibilités d’un redémarrage dans les règles de l’art. |

Summary, etc. | "Failure". This is the word that emerged from statements at the end of the process entitled "Towards a Global Pact for the Environment", initiated by the United Nations in May 2018 and completed on 23 May 2019. The decision of the Working Group to abandon the idea of a legally binding global pact for a non-binding political declaration aroused deep discomfort within civil society and among many government entities that seemed to have placed much hope in the wished-for pact. But is "failure" appropriate? "Sinking"! This is the word we suggest. In terms of approach, the process was less likely to succeed because of its speediness, the decision based on consensus, the less favourable geopolitical context, and diplomats having to decide on fundamental legal questions still under debate in scientific circles. In terms of substance, the intended goal was to ascertain the need for a global pact to address the gaps in international environmental law and environment-related texts. Before that, however, it was first necessary to agree on the concept of legal gap. "Sinking" would also translate the prospect of a proper restart of the process. |
