| Summary, etc. | Ces angles morts désignent les hypothèses dans lesquelles la doctrine juridique délaisse certaines questions qui paraissent inaccessibles à son champ de vision et qui, de ce fait, ne sont pas traitées. L’objectif est donc de faire l’inventaire, évidemment incomplet et subjectif, des questions orphelines pour tenter de convaincre que nous faisons fausse route en les ignorant. Il repose sur une triple observation. La première conduit à constater la bouderie persistante que manifeste la doctrine environnementaliste dominante à l’égard des questions environnementales liées à l’entreprise et, au-delà, au système économique et financier ; la deuxième vise à souligner combien la doctrine majoritaire a tendance à se focaliser sur les principes en délaissant volontiers de mener une réflexion et de développer des analyses sur les instruments ; la dernière, enfin, tentera d’identifier les territoires que la doctrine n’explore que trop timidement ou pas du tout, comme par exemple la relation entre intelligence artificielle et droit de l’environnement. |

| Summary, etc. | These blind spots refer to hypotheses in which the legal doctrine abandons certain issues that seem inaccessible to its vision and which, as a result, are not covered. The objective is therefore to make an inventory, obviously incomplete and subjective, of orphan issues to convince us that we are on the wrong track by ignoring them. It is based on a three-fold observation. The first confirms the persistent disregard shown by the dominant environmentalist doctrine for environmental issues related to the enterprise and, beyond that, to the economic and financial system; the second aims to underline the extent to which the mainstream doctrine tends to focus on principles, neglecting reflection and analyses on instruments; the last, finally, will attempt to identify the territories that the doctrine explores only too timidly or not at all, such as the relationship between artificial intelligence and environmental law, for example. |
