| Summary, etc. | Au Canada, s’il existe bien des procès de droit constitutionnel mettant en jeu des réglementations, telles que la taxe carbone fédérale ou des autorisations de projets d’oléoducs et de gazoduc, qui ont indirectement un lien avec les changements climatiques, peu de recours « climatiques » à proprement dit ont été intentés devant le juge canadien, jusqu’à celui logé par l’ONG Environnement Jeunesse contre le gouvernement canadien, en 2019. Cette rareté du contentieux climatique canadien amène à s’interroger sur les raisons pouvant potentiellement l’expliquer. L’analyse de cette affaire ne devient vraiment intéressante que lorsqu’elle bénéfice de l’éclairage qu’apporte la comparaison des véhicules procéduraux utilisés et des moyens substantifs plaidés, dans pareilles affaires, ailleurs dans le monde. |

| Summary, etc. | In Canada, while there are many constitutional lawsuits involving regulations, such as the federal carbon tax or authorizations for oil and gas pipeline projects, which are indirectly linked to climate change, few legal remedies directly related to climate change have been filed before Canadian judges, until the one brought to court by the NGO Environnement Jeunesse against the Canadian government in 2019. This rarity of the Canadian climate litigation raises questions about the reasons potentially explaining it. The analysis of this case becomes really interesting only when it benefits from the light which brings the comparison of the procedural vehicles used and substantive means pleaded in such cases, elsewhere in the world. |
