| Summary, etc. | Un mouvement général de lutte contre le gaspillage des ressources s’observe actuellement. Madagascar n’est pas en reste. Afin d’accomplir l’objectif 12 des objectifs de développement durable (ODD), c’est-à-dire, établir un mode de consommation et de production durables, la question des déchets et celle de la pollution sont essentielles. Plusieurs textes ont été adoptés en droit malgache afin de transposer les différentes dispositions des conventions internationales en la matière. La question est mitigée quand il s’agit d’analyser les mesures qui ont été prises en interne, indépendamment de ces traités internationaux. En effet, si la pollution industrielle est saisie par le droit malgache, il n’en est pas de même pour les autres types déchets. Et plus particulièrement, à l’heure où la lutte contre la pollution plastique est d’actualité, l’analyse des mesures prises en la matière illustre une certaine régression des textes malgaches. |

| Summary, etc. | There is a global movement against the waste of resources. Madagascar is part of this movement. In order to achieve goal 12 of the sustainable development objectives (SDOs), i.e. to establish a sustainable consumption and production pattern, the issue of waste and pollution are essential. Several texts have been adopted in Malagasy law in order to transpose the various provisions of international conventions on the subject. The question is mixed when it comes to analysing the measures that have been taken internally, independently of these international treaties. Indeed, while industrial pollution is covered by Malagasy law, the same is not true for other types of waste. And more particularly, at a time when the fight against plastic pollution is a topical issue, the analysis of the measures taken in this field illustrates a certain regression in Malagasy texts. |
