| Summary, etc. | En tant qu’objet juridique complexe, l’eau a été le réceptacle d’un traitement juridique épars. Relevant initialement de la compétence nationale, la nature transfrontière de l’eau a justifié une appréhension commune pour préserver sa qualité et sa quantité. Cet impératif de protection des eaux est le fondement de l’intervention de l’Union européenne. De cette appréhension découle un droit européen de l’eau. En revanche, de nombreux questionnements juridiques liés à l’accessibilité de l’eau demeurent. Si le projet d’un droit à l’eau a été conceptualisé dans certains États membres, aucune consécration n’a eu lieu en droit international et en droit de l’Union européenne. Pour cause, l’introduction d’un régime juridique relatif à l’accès est susceptible d’affecter le cadre de protection des eaux et les intérêts de marché de l’eau. Néanmoins, l’impératif de garantir un accès de tous à l’eau fait écho au sein de l’Union européenne. Une réflexion axée sur une conciliation entre intérêt général et environnemental est le corollaire d’un droit européen à l’eau. |

| Summary, etc. | As a complex legal object, water has been subject to a fragmented legal treatment. The transboundary nature of water has however required a common framework to preserve its quality and quantity. Protection of water is the legal basis of the European Union’s intervention. Nevertheless many legal questions related to water accessibility are still open. While the project of a right to water has been designed in some Member States, there has been no recognition in international law and European Union law. Indeed, the introduction of a legal system for access is likely to affect the water protection framework and water market interests. But the guarantee of access to water for all is required within the European Union. A reflection focused on a balance between the general and environmental interests is necessary to introduce a European right to water. |
